REMINDER: When to use the TPMO disclaimer

February 12, 2024
UPMC

As a reminder, the Centers for Medicare & Medicaid Services (CMS) released regulations that state all marketing, sales, and enrollment calls must be recorded in their entirety and the TPMO disclaimer must be stated in the first minute of any sales call.

If you do not sell all plans in your area, state the following:
“We do not offer every plan available in your area. Currently we represent [insert number of organizations in your area] organizations which offer [insert total number of plans from all represented organizations] products in your area. Please contact Medicare.gov,1–800–MEDICARE, or your local State Health Insurance Program to get information on all of your options.”

If you do sell all plans in your area, state the following:
“Currently we represent [insert number of organizations in your area] organizations which offer [insert total number of plans from all organizations in your area] products in your area. You can always contact Medicare.gov,1–800–MEDICARE, or your local State Health Insurance Program for help with plan choices.”

The TMPO disclaimer should also be used:

  • On any broker websites.
  • Electronically when communicating with a client through e-mail or online chat.
  • In any marketing materials, such as a letter, flier, postcard, etc.

Remember, UPMC for Life gives you access to CMS-approved materials that include the TPMO disclaimer that you can easily personalize. For self-mailers, fliers, and more, visit the Marketing Storefront site. For letters and email templates as well as social media posts, visit the Broker training site.
